Contractual Relationship
Please read these Terms of Use before using this website, as they constitute a legal agreement between you and Peter Pfitzinger trading as Pfitzingercoaching.com, “Pfitzingercoaching.” These Terms of Use ("Terms") govern your access or use of our applications, websites, content, text, graphics, links, products, and services ("Services"). By accessing or using the Services, you confirm your agreement to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services. These Terms constitute the entire agreement between you and Pfitzingercoaching with respect to the access or use of the Services and the content contained therein and expressly supersede any prior agreements or arrangements with you.
Pfitzingercoaching reserves the right to immediately terminate or modify these Terms or any Services or deny access to the Services or any portion thereof, at any time for any reason. Continued use of the Services after any modification of the Terms or Services constitutes acceptance of any such modified Terms or Services.

Pfitzingercoaching makes no representations about the results to be obtained from using the Services. The use of the Services is at your own risk.
PFITZINGERCOACHING ASSUMES NO LIABILITY OR RESPONSIBILITY FOR DAMAGE OR INJURY TO PERSONS OR PROPERTY ARISING FROM ANY USE OF ANY EXERCISES, PROGRAMS, PRODUCTS, INFORMATION, IDEAS, OR INSTRUCTIONS CONTAINED IN THE MATERIALS PROVIDED TO YOU.
The Services are provided on an "as is" basis without any warranties of any kind. Pfitzingercoaching, their licensors, and their suppliers, to the fullest extent permitted by law, disclaim all warranties, whether express or implied, statutory, contractual, or otherwise, including but not limited to any implied warranties of merchantability, non-infringement of third parties' rights, and fitness for a particular purpose. Pfitzingercoaching, their licensors, and their suppliers make no representations or warranties about the accuracy, reliability, completeness, currency or timeliness of the Services.
Limitations on Liability
Pfitzingercoaching shall not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, including lost profits, lost data, personal injury, or property damage related to, in connection with, or otherwise resulting from any use of the Services, regardless of any purported negligence (either active, affirmative, sole, or concurrent) of Pfitzingercoaching, even if Pfitzingercoaching has been advised of the possibility of such damages.
Pfitzingercoaching shall not be liable for any damages, liability or losses arising out of your use of or reliance on the Services or your inability to access or use the Services, even if Pfitzingercoaching has been advised on the possibility of such damages. Pfitzingercoaching shall not be liable for delay or failure in performance resulting from causes beyond its control or for or relating to any delay, failure, interruption or corruption of any data or other information transmitted in connection with use of the Services.
Indemnity
You agree to defend, indemnify, reimburse, and hold harmless Pfitzingercoaching, and its officers, directors, employees, agents, licensors and suppliers, from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your use of the Services. Pfitzingercoaching shall provide notice to you promptly of any such claim, suit, or proceeding and shall reasonably cooperate with you, at your expense, in your defense of any such claim, suit or proceeding.
Ownership and Use of Content and Intellectual Property Rights
Upon acceptance of these Terms, Pfitzingercoaching authorizes you to view and use the material provided by the Services solely for your personal, non-commercial use.
The content constituting part of or relating to the Services, such as text, graphics, images, videos, training materials, products, and/or other materials, are protected by copyright, trademark, and other such laws under both United States and foreign laws, and title to the content shall not pass to you or any other user.
Unauthorized use of the Services may violate copyright, trademark, and other laws. None of the Services may be copied, reproduced, republished, uploaded, posted, transmitted, transcribed, translated into any language, distributed, or used for public or commercial purposes in any way without the prior written consent of Pfitzingercoaching.
Services are subject to change without notice at the editorial discretion of Pfitzingercoaching. If you violate any of these Terms, your permission to use the Services automatically terminates and you must immediately discontinue use of the Services and destroy any copies you have made of any portion of the Services.
Choice of Law and Venue
This Agreement is governed by the laws of New Zealand, and the parties submit to the exclusive jurisdiction of the New Zealand courts.

Maintaining your privacy is of paramount concern to Pfitzingercoaching.
